Section 11 contains a binding arbitration clause and a class action waiver. It affects how disputes between us are resolved. You can opt out of it within 30 days.
1.Acceptance and eligibility
These terms are an agreement between you and TrustLine BPO Ltd. By using our sites, submitting a form, calling us or replying to a text, you agree to them and to our Privacy Policy. If you do not agree, please do not use our sites or submit a request.
You must be at least 18 and able to enter a binding contract. Our quote request services are offered to residents of the United States only. TrustLine BPO Ltd is registered in England and Wales, with operations in Oldham, England and in Texas, United States.
Where we provide services under a separate signed contract, that contract governs and these terms apply only where they do not conflict with it.
2.What we do and what we do not do
We operate marketing websites and quote request forms. When you submit a request we check it and refer it to one or more licensed insurance agents, agencies or carriers who may contact you about the coverage you asked about. We are paid for that referral.
- We are not an insurance company and do not underwrite or issue any policy.
- We do not provide quotes or rates. Only a licensed agent or an insurer can quote you.
- We do not decide coverage. Underwriting, eligibility and pricing belong entirely to the insurer.
- We are not affiliated with or endorsed by any government agency, including Medicare or the Social Security Administration.
We do not guarantee that an agent will contact you, that any product will be available to you, or that any quote will be at a particular price. We do not control what an agent says to you after your details are transferred.
3.The information you submit
When you submit a request you confirm that the information is true and complete, that the phone number and email address are yours and you are authorized to give consent for them, that you are submitting for yourself, and that you are 18 or older.
Please do not send a Social Security number, Medicare Beneficiary Identifier, payment card number or medical records through our forms. We may reject a request that appears inaccurate, duplicated, automated or submitted without valid consent.
4.Consent to be contacted
Where you check the consent box, you give prior express written consent for TrustLine BPO and the licensed insurance agents, agencies and carriers we work with to contact you at the phone number and email address you provided, including a wireless number, about the coverage you asked about. You agree these contacts may use an automatic telephone dialing system, prerecorded, artificial or AI generated voice messages, and text messages, even if your number is on a do-not-call registry.
Consent is not a condition of purchasing anything. Message and data rates may apply and message frequency varies.
You may withdraw consent at any time. Reply STOP to any text, tell an agent on a call to add you to our do-not-call list, use the unsubscribe link in any email, or email info@trustlinebpo.com. We act on withdrawal requests promptly. If an agent already has your details, ask them directly as well, since they keep their own lists. We keep a record of the consent you gave, as described in our Privacy Policy.
5.Call recording
Calls to and from our contact center are recorded and may be monitored for quality, training and compliance. You are told this at the start of the call, and continuing the call is your consent. If you do not consent, tell the agent and the call will be ended. Federal Medicare rules require sales and enrollment calls to be recorded in full, so recording cannot be turned off on those calls.
6.No insurance advice
Everything on our sites is general marketing information. It is not insurance, legal, tax, financial or medical advice, and it is not a recommendation that any product suits you. Benefits, availability, rates and underwriting rules vary by state, age, health, carrier and enrollment period, and change over time.
Speak to a licensed agent and read the policy documents before deciding. Do not cancel existing coverage until replacement coverage is issued and in force.
7.Medicare notices
We do not offer every plan available in your area. Any information we provide is limited to those plans we do offer in your area. Please contact Medicare.gov, 1-800-MEDICARE, or your local State Health Insurance Program to get information on all of your options.
This is a solicitation for insurance. By submitting a Medicare quote request you agree that a licensed insurance agent may contact you, and you understand that your information will be provided to a licensed insurance agent who may call you about Medicare plan options.
TrustLine BPO is not connected with or endorsed by the United States government or the federal Medicare program. Enrollment is generally limited to specific enrollment periods unless you qualify for a Special Enrollment Period.
8.Acceptable use
You agree not to submit false or fraudulent information or another person's details without their authority; use bots, scrapers or automated tools on our sites; attempt to gain unauthorized access to our systems or interfere with them; send malware or spam; or use our sites for any unlawful purpose or in breach of telemarketing, consumer protection or advertising law. We may suspend access and report conduct to the authorities if these terms are breached.
9.Our content and third parties
Our sites and their content, design, code and branding are owned by TrustLine BPO Ltd or our licensors. You may view and print pages for personal, non-commercial use. Any other use requires our written permission. Other names and marks belong to their owners.
Our sites link to sites we do not operate, and your request may be transferred to independent insurance agents and carriers. We are not responsible for their content, services, pricing, licensing or conduct. Any dealing with them is between you and them.
10.Disclaimers and liability
Our sites and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that our sites will be accurate, current, secure or uninterrupted, and we make no warranty about any agent, carrier or product referred to on them.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for all claims will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars. We are not liable for the acts of any insurance agent or carrier, for any policy sold to you, or for any claim denied.
Some states do not allow these exclusions, so parts of this section may not apply to you. Nothing here waives a right that cannot be waived under state or federal law, or excludes liability for fraud.
You agree to indemnify TrustLine BPO Ltd and its officers, employees and agents against any claim or cost arising from your breach of these terms or of any law, or from information you submitted that was false or that you were not authorized to submit.
11.Arbitration and class action waiver
Please read this section carefully. It affects your legal rights. It requires most disputes to be resolved by binding individual arbitration rather than in court, and waives your right to a jury trial and to take part in a class action.
Talk to us first. Before starting arbitration, send written notice to info@trustlinebpo.com describing the dispute and the relief you want. We will do the same. Both of us agree to try in good faith to resolve it within 60 days.
Arbitration. If we cannot resolve it, any dispute relating to these terms, our sites or our services will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, conducted in English by written submissions, videoconference or in the county where you live, at your choice. The Federal Arbitration Act governs this section.
Individual basis only. You and TrustLine BPO each waive the right to a jury trial and to bring or join a class, collective or representative action. If this waiver is unenforceable as to a particular claim, that claim alone proceeds in court and the rest remain in arbitration.
Exceptions. Either of us may bring an individual claim in small claims court, or seek an injunction in court to protect intellectual property or stop unauthorized access to our systems.
How to opt out. Email info@trustlinebpo.com with the subject Arbitration Opt-Out within 30 days of first accepting these terms. Include your name and the email address and phone number you used. Opting out does not affect any other part of these terms.
12.Governing law
These terms and any dispute relating to them are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict of law rules. Where section 11 does not apply, you and TrustLine BPO agree to the exclusive jurisdiction of the state and federal courts located in Texas.
Nothing here deprives you of mandatory consumer protections under the law of your state of residence, or of your right to bring an individual claim in small claims court. Our sites are directed to users in the United States and we make no representation that they are appropriate elsewhere.
13.General
- These terms and the Privacy Policy are the whole agreement between us about our sites and services.
- If any provision is unenforceable it is severed and the rest remains in force.
- Not enforcing a provision is not a waiver of it.
- You may not assign your rights. We may assign ours in a merger or sale of assets.
- We are not liable for failures caused by events outside our reasonable control.
- Sections 6, 9, 10, 11, 12 and 13 survive termination.
- Under California Civil Code section 1789.3, California residents may report a complaint to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone on (800) 952-5210.
14.Changes and contact
We may update these terms. The last updated date at the top shows when the current version took effect, and material changes will be notified on our sites before they take effect. Continuing to use our sites means you accept the updated terms.
